Why Original Mortgage Principal Is Not Current Payoff

The number on the notice is what was borrowed. What is owed today is not in any public record. Here is how to use the spread without fooling yourself.

Every foreclosure notice and every deed of trust states the original principal of a loan. It is the one debt figure public records offer, and it is routinely mistaken for the amount owed. It is not.

What moves the payoff down

Amortization. A thirty-year loan from 2005 has had two decades of scheduled principal reduction; a $148,750 note may have a balance well under $90,000 by now. Extra payments and partial paydowns are likewise invisible.

What moves it up

Arrears, late fees, escrow advances for taxes and insurance the servicer paid, foreclosure costs and attorney's fees. A loan two years in default can carry a payoff above its original principal. A modification that capitalized missed payments does the same, and the modification agreement rarely states the new balance in the index.

The spread between county value and original principal is a screening tool. It ranks properties worth a closer look. It is not equity, and PlotCipher never reports it as equity.

Home equity and second liens

Texas home equity loans and second-lien deeds of trust are separate instruments with their own original principal. A property with a $148,750 first lien and a $40,000 home equity deed of trust from 2014 has two debts unless one was released. The instrument guide explains how to tell.

What a release does and does not tell you

A release of lien means a loan was paid off. No release means the index has not recorded one, which is the honest starting assumption but not proof of an open balance: releases are sometimes recorded late or under a slightly different name.

Using the spread properly

Treat county value minus original principal as an upper bound on the room in the deal, before senior liens, taxes, repairs and the true payoff. Then verify: request a payoff figure where you can, pull the tax status, and have a title company confirm what survives the sale. PlotCipher's research shows every recorded loan on a property with its original principal, its assignments and its release status, and lists the current balance as unknown, because it is.
